isitUp is a community-driven platform that provides real-time status monitoring and reporting for third-party online services. The Service allows users to view service statuses, submit status reports, add services to a personal watchlist, and post comments. isitUp is an independent service monitor and is not affiliated with, endorsed by, or connected to any of the third-party services monitored on the platform.

If isitUp provides a public API, your use of the API is subject to these Terms and any additional API-specific terms or rate limits we may publish. We reserve the right to throttle, restrict, or revoke API access at any time and for any reason, including but not limited to abuse, excessive usage, or violation of these Terms.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
STATUS DATA DISPLAYED ON THE SERVICE IS COMMUNITY-REPORTED AND PROVIDED FOR INFORMATIONAL PURPOSES ONLY. WE DO NOT GUARANTEE THE ACCURACY, TIMELINESS, OR RELIABILITY OF ANY STATUS INFORMATION. USERS SHOULD NOT RELY SOLELY ON ISITUP FOR CRITICAL BUSINESS DECISIONS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ISITUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless isitUp and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
The Service monitors and displays information about third-party services. We are not responsible for the availability, content, or practices of any third-party service. Any interactions you have with third-party services are solely between you and the third party. References to third-party services on isitUp do not constitute an endorsement or recommendation.
We may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will cease immediately. Sections of these Terms that by their nature should survive termination — including but not limited to intellectual property, disclaimers, limitations of liability, and indemnification — shall survive termination.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which isitUp operates, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless you are located in a jurisdiction where arbitration agreements are not enforceable, in which case disputes shall be subject to the exclusive jurisdiction of the courts in the applicable jurisdiction.
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and isitUp regarding your use of the Service and supersede all prior agreements and understandings.
